By hiring Mentawai Surf Photos you agree to the following terms and conditions:

 

1.“Image(s)” means all visual representations furnished to Mentawai Surf Photo’s clients (referred to henceforth as ‘client(s)’) by Mentawai Surf Photo’s Photographers (referred to henceforth as ‘photographer(s)’), whether captured, delivered, or stored in photographic, magnetic, optical, electronic, or any other media. All Images and rights relating to them, including copyright and ownership rights in the media in which the Images are stored, remain the sole and exclusive property of Photographer.

 

2. Mentawai Surf Photos images are copyrighted by the photographer(s) and for Private, Single Use Only. Images are not to be used for commercial purposes including, but not limited to, publications, internet and advertising/promotions without written consent from the photographer or agent. Additionally, images are not to be resold or posted online with the intent to sell.

 

3. Model release. For valuable consideration received, I hereby grant to the photographer(s) the absolute and irrevocable right and unrestricted permission in respect of photographic portraits or pictures that he/she had taken of me or in which I may be included with others, to use, reuse, publish, and republish the same in whole or in part, individually or in any and all media now or hereafter known, and for any purpose whatsoever, for illustration, promotion, art, editorial, advertising, and trade, or any other purpose whatsoever without restriction as to alteration; and to use my name in connection therewith if he/she so chooses. I hereby release and discharge Photographer from any and all claims and demands arising out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, as well as the person(s) for whom he/she took the photographs. I am of full age and have the right to contract in my own name. I have read the foregoing and fully understand the contents thereof. This release shall be binding upon me and my heirs, legal representatives, and assigns. If I am a minor my parent or guardian has read, understood and accepted this agreement.

 

4. Photographer owns all images taken during an assigned surf charter and reserves the right to limit distribution of those images to Mentawai Surf Photos clients. Specifically, images of Pro Surfers and certain scenery images are not owned by clients and all may not be distributed to clients. Additionally, images of surfers on other charters are not owned by clients and will not be given away or traded to other surf charters for photos or video from other photographers. Mentawai Surf Photos photographers and their agents own all images and retain the rights to sell or distribute these images.

 

5. In the event of a cancellation no less than 60 days before scheduled surf charter, deposits and/or final payments will not be refunded, but a full credit in the amount of the deposit and/or final payment will be valid for use one year from the date of cancellation minus expenses for flights and/or travel arrangements as agreed to by Mentawai Surf Photos. Cancellations within 60 days of surf charter will forfeit deposits and/or final payments.

 

6. No refunds will be given due to lack of surf, adverse weather conditions, accident, injury, political instability, natural disasters, or any other reason. Mentawai Surf Photos, the surf charter companies, and their agents have no control over the wind and the waves and other acts of god. We can not guarantee perfect conditions.

 

7. It is understood by clients that surfing is a dangerous sport and safety precautions are the responsibility of the clients. Therefore, clients will not hold Mentawai Surf Photos, the photographers/videographers, the surf charter companies, and their agents or representatives responsible for accidents, injury or death resulting from participation in a surf charter and/or surfing in the Mentawai Islands. It is further understood that surfing with a water photographer also has certain risks and it is agreed the clients are responsible for any accident, injury or death as the result of surfing with a water photographer.

 

8. Photographers do not lend photographic or computer equipment to clients. In addition photographers are not responsible for downloading clients photos, video or other media from clients camera, video or other electronic devices. Loss or damage as a result of unauthorized use of photographer’s equipment will be the responsibility of the client group as a whole and will include reimbursement plus expenses to replace the equipment and the loss of work and/or opportunity costs associated with the damaged or lost equipment.

 

9. Clients agree not to hire Mentawai Surf Photo’s photographers directly for future photographic assignments in Sumatra and/or the Mentawai Islands without booking through Mentawai Surf Photos. Further, Clients agree not to hire Mentawai Surf Photo’s photographers directly for future photographic assignments in other parts of the world without booking through Pro Surf Photos.
